Dupital Patient Terms of Use & Consent (UK)

By ticking “I agree” and using the simulation service, you agree to these Terms.

1) What the service is

- You can upload a photo to receive an illustrative, non‑predictive simulation of potential aesthetic/dental outcomes.

- It is not medical advice, diagnosis, treatment, or a guarantee of results.

- Actual results vary due to anatomy, clinical technique, healing, and other factors.

2) Eligibility and acceptable use

- You must be 18+ and have the right to upload the image; reasonable age gating may apply.

- Use is personal and non‑commercial. No unlawful, infringing, or harmful content.

- Do not remove or obscure any on‑image disclaimer (e.g., “Illustrative simulation. Actual results will vary.”).

3) POM (prescription‑only medicines) simulations

- Simulations that imply the effects of a prescription‑only medicine (e.g., botulinum toxin, weight‑loss injectables) will only be shared privately after you initiate a consultation with a prescriber/clinic.

- Such simulations must not be shown publicly on websites or social media.

4) Consent to image processing

By proceeding, you give explicit consent to:

- Upload and processing of your image(s) to generate the simulation,

- Storage of your data for up to 30 days (or less upon your request), and

- Sharing the simulation with the clinic you engaged (if applicable).

You can withdraw consent at any time via your clinic or by contacting Dupital; we will act without undue delay, coordinating with your clinic. We do not use your images for model training or marketing unless you provide separate, explicit opt‑in consent (and your clinic permits it).

5) No medical relationship

- We provide technology only. We are not a clinic or medical professional.

- Using the service does not create a doctor‑patient relationship. Clinical advice comes from your clinic.

6) Disclaimers and liability

- The service is provided “as is” and “as available.” We do not guarantee accuracy, availability, or that simulations reflect real outcomes.

- To the fullest extent permitted by law, we are not liable for indirect or consequential losses. Our total liability to you will not exceed £100.

- Nothing limits liability for fraud or for death/personal injury caused by negligence, to the extent such limits are unlawful.

7) Intellectual property

- The service and software are owned by Dupital or its licensors. You retain rights in your uploaded content.

- You grant us a limited licence to process your content solely to deliver the service and create the simulation. We may use anonymised, aggregated usage data to improve the service.

8) Governing law and disputes

- These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

9) Changes to these Terms

- We may update these Terms. The new version will be posted with an updated date. Continued use constitutes acceptance.
